This document defines the terms and conditions of our working relationship. All projects or services that may be contracted to produce or provide for you, the client, will be subject to the following:
Working & Billing Phases
Upon agreement of pricing and services, Inkstone will send you an initial invoice. Upon receipt of that invoice, we require 100 percent of the total invoiced cost for a project or billing period. A project will begin upon client’s approval of the written proposal and of the terms in this agreement. Rush projects may be subject to an additional turnaround fee.
If your work must be completed by a specific time, please indicate a date and time before you pay the amount in your invoice. We will make every effort to complete the project by the deadline.
Cancellations and Refunds
Inkstone does not accept cancellations and does not offer a satisfaction guarantee. However, we will consider refunding your payment if the work was not satisfactory. If we have not begun working on your project at the time of a cancellation request, we will consider refunding your payment. Please cancel your service and/or request a refund as early as possible.
Revisions & Alterations
New work requested by the client and performed by Inkstone after a proposal/estimate has been approved is considered a revision or alteration. If the job changes to an extent that substantially alters the specifications described in the original project proposal, we will submit a new proposal to the client and the revised estimate must be agreed to by both parties before further work proceeds.
Licensing & Ownership
Inkstone hereby assigns to you, the client, all rights, title and interest in the work produced under this agreement, except that author & vendors retain display rights in the work, for use in portfolios, exhibitions and other self-promotion channels. This is the parties’ entire agreement on this matter, superseding all previous negotiations or agreements.
Indemnification and Hold-Harmless by Client
Client agrees to indemnify and hold Inkstone and all entities which contribute to the client’s project(s) harmless from any and all losses, claims, damages, expenses or liabilities (including reasonable attorneys' fees) which Inkstone may incur based on information, representations, reports, data or product specifications furnished, prepared or approved by Client for use by Inkstone in the work performed under this Agreement.
